Why Kalshi is allowed when sports betting is not
California has no legal sports betting: in 2022 voters rejected both an in-person tribal proposal (Proposition 26) and an online proposal (Proposition 27). The tribal case: Blue Lake Rancheria v. Kalshi
In California, gambling is a tribal business: tribes hold the exclusive right to run casinos. Three tribes sued Kalshi and its distributor Robinhood, arguing that sports contracts traded on their reservations are illegal casino-style ("Class III") gaming under the federal Indian Gaming Regulatory Act.

But it is the first appeals ruling on prediction markets brought by tribes, and California's attorney general, Rob Bonta, has joined multistate court filings backing states and tribes against Kalshi.
