Yes. Texans can legally use Polymarket through Polymarket US, the CFTC-regulated app, and trade its sports, politics and economics contracts. The original global site, polymarket.com, does not accept US residents, Texans included. As of October 2026 Texas had taken no action against Polymarket or other prediction markets, even though sports betting itself is illegal in the state.

As of 23 October 2026. Polymarket US checks your location at sign-up and when you trade; what the app shows is what you can trade.

Polymarket in Texas at a glance

Status in Texas
Polymarket US Available, sports contracts included
Global polymarket.com Not open to US residents
Minimum age 18
Online sportsbooks Illegal
State tax on winnings None: Texas has no personal income tax
Kalshi Also available, sports included (Kalshi in Texas)

Polymarket US is a designated contract market regulated by the Commodity Futures Trading Commission, the same category as futures exchanges. Under federal law the CFTC oversees trading on those exchanges, and Polymarket, like Kalshi, argues that this overrides state gambling law for the contracts it lists (is Polymarket legal in the US?).

Polymarket's history matters here. It paid a CFTC penalty in 2022 for serving Americans without a licence and blocked them for three years, then bought a licensed exchange and returned with Polymarket US in December 2025. Texans who remember being shut out are not imagining it; the US app is the legal route back in.

Why Texas has not acted

Most states fighting prediction markets license sportsbooks and see event contracts as unlicensed competition: Nevada, Massachusetts, Tennessee and Ohio among them (Polymarket sues Ohio). Texas has no sportsbooks to protect, and its attorney general, Ken Paxton, has not joined the multistate coalition of attorneys general against prediction markets.

That does not mean everyone in Austin is comfortable:

  • Lieutenant Governor Dan Patrick asked the Texas Senate in March 2026 to examine the loopholes that let prediction markets operate in the state.
  • The Texas Medical Association pushed in July 2026 for safeguards, including a possible 21+ age limit and advertising limits.
  • The legislature next meets in regular session in January 2027, the first real chance for a state law on prediction markets.

What Texans can trade on Polymarket US

  • Sports: NFL, college football, NBA and MLB, including game winners, totals, futures and combos (parlays) (parlays explained).
  • Politics: the Texas Senate race between Ken Paxton and James Talarico, one of the most traded races of 2026 (Texas Senate odds), plus control of Congress (2026 midterm predictions).
  • Economics and culture: Fed decisions, inflation, awards and entertainment.

The US app lists a subset of the global site's catalogue, so some world-politics and crypto markets you see quoted on polymarket.com are not available to Texans.

How to sign up for Polymarket in Texas

  1. Download Polymarket US from the App Store or Google Play.
  2. Create an account and verify your identity; you must be 18 or older.
  3. Allow location access; the app confirms you are in an eligible state.
  4. Deposit by debit card, Apple Pay or bank transfer (how to deposit on Polymarket). New-user promo codes add trading credit (Polymarket promo code).
  5. Trade. Takers pay up to $1.74 per 100 contracts at 50¢; resting limit orders pay nothing (Polymarket fees).

Taxes on Polymarket winnings in Texas

Texas has no personal income tax, so there is no state tax on prediction-market gains. Federal tax still applies, and how gains are reported depends on the platform's forms (how prediction market winnings are taxed).

Polymarket vs Kalshi in Texas

Polymarket US Kalshi
Available in Texas Yes Yes
Sports contracts Yes Yes
Taker fee at 50¢ (100 contracts) $1.74 $1.75
Minimum age 18 18
Strongest in Politics, culture, sports Sports, economics, weather

A third regulated option, Fanatics Markets, is also open in Texas, but only to adults 21 and over (Fanatics Markets review).

Can Texans use the global Polymarket site with a VPN?

Don't. The global site's terms bar US persons, it can freeze accounts it identifies as American, and you would give up the protections of a US-regulated exchange. With Polymarket US available in Texas, there is no reason to take the risk (where Polymarket is legal).

Risks to watch

  • The 2027 legislative session could add an age limit, advertising rules or tougher measures.
  • The Supreme Court may decide whether states can regulate sports event contracts; its answer would apply in Texas too (Kalshi and the Supreme Court).
  • Federal rules: the CFTC is rewriting its event-contract rules (CFTC proposal).
