Why Polymarket is legal in Florida
Polymarket US is a designated contract market regulated by the CFTC, and Polymarket argues that federal oversight of its contracts overrides state gambling law (is Polymarket legal in the US?). Florida has not tested that argument in court, and state-by-state trackers, including CBS Sports' on 23 October, list Florida as having imposed no restrictions.
The Seminole question
Florida is unusual: legal sports betting exists, but only through the Seminole Tribe, whose compact with the state gives it exclusive rights to run it through Hard Rock Bet since November 2023. That makes prediction markets a potential competitor to a tribal monopoly:
- In February 2026, Governor Ron DeSantis questioned how Kalshi's sports contracts square with the Seminole compact.
- In October, the Seminole Tribe sued DraftKings in Broward County, claiming illegal sports betting, and DeSantis urged the courts and Congress to settle the question quickly.
Neither the state nor the tribe has acted against Polymarket. The risk for Florida traders is that a ruling elsewhere, at the Supreme Court or in a tribal case, changes the picture (Kalshi and the Supreme Court).
What Floridians can trade
